Do I need to obtain a Probate?

When someone dies their estate may need to go through Probate in order to release the assets for distribution to their loved ones.
To start with, you would need to determine whether a Will was made and if the original signed and witnessed copy is ready available.
If there was no Will, then they would be deemed as dying Intestate, which simply means without a Will.
This in turn, then means that the government bloodline template will apply for the administration of the estate, and this may not be exactly what the deceased would have wanted.

What is Probate?

Probate is the legal process required in order to obtain the Grant of Probate document.
This is required when an Executor is dealing with the deceased’s assets such as bank accounts, investments, property and tax affairs.
In order to implement the instructions in a Will, Probate is required so that the Executor has the legal power to sell assets, collect funds and make necessary payments out to any Beneficiaries.
